Background

From the October 21st 1935 edition of the Lima News:

     Fifteen years ago newspapers were filled with details of one of the most sensational murder trials of a decade.  One night the broken lifeless body of a young man, a cripple, was found in a roadside ditch near his home.  On the surface, it appeared to be another fatal accident chargeable to some reckless hit-skip motorist.  The district attorney thought otherwise.  The outcome of this weird crime will be re-enacted at 10 p.m. Monday over CKLW, Detroit-Windsor and also WGN, Chicago.  (Also WLW, but the nation's station is still "mushing out" badly in the Lima district, so don't try it.)
     This spectacular trial will form the basis of the "Famous Jury Trials" series.  The broadcast will present an authentic version of the trial.  Ficticious names and locations will be substituted for obvious reasons.

     "Famous Jury Trials," one of the nation's most popular features last year, comes to KRBC at 9 to 9:30 this evening in the first presentation of the thrilling new series, through the Mutual Broadcasting System.  Tonight's story, "The People versus Margaret Travis."
     "Famous Jury Trials" will be produced in New York before a studio audience, using scenic effects, such as judges' platform, jury box, to create the atmosphere of a real court room.
     One of radio's most popular script programs, "Famous Jury Trials" owes much of its popularity with listeners to the persistence of authors Martin H. Young and Samm Baker to make each case authentic and legally correct.  Young, a brilliant New York trial lawyer, first prepares each broadcast as he would an actual brief for a court trial.  Legal loopholes are thus avoided.  Then Baker whips the "brief" into broadcast routine, deleting the routine testimonies and highlighting the incriminating evidence and clues.

      The exciting spectacle of a man on trial for attempted murder...faced in the courtroom by the very person whom it is charged he tried to kill...furnishes the thrilling basis for this sensational reenactment of one of the world's famous jury trials, to be heard over KRBC through the Mutual network tonight from 9 to 9:30 o'clock.  Add to this situation the fact that the two men involved were close associates as executives in an important hospital, and it is easy to realize why this case held the front pages of newspapers for days when it occurred in real life. 
     When William Evans parked his auto in his home garage one night, a man appeared in the gravel driveway, fired a shotgun at Evans and fled.  Because Evans slipped and fell as he turned to escape his assailant, the shot missed him.  He claimed that the would-be murderer was Robert Spencer, a prominent hospital superintendent.  A neighbor who saw the fleeing figure claimed to recognize Spencer's auto pulling away, but could not positively identify the man who made the "running footsteps."
     The stirring testimony revealed another murder which had occurred several years before in the same city--in which "running footsteps" were involved.  Evans accused Spencer of that previous murder also, and stated that Spencer hated him because he had disclosed to hospital authorities a notorious episode in which Spencer was involved.  Listeners can decide whether or not Spencer was guilty...and then check with the Jury's actual verdict!

From the November 9th 1938 edition of the Big Spring Daily Herald:

"Famous Jury Trials," the program that brings to radio listeners reenactments of world famous actual courtroom cases, will broadcast a case that parallels one currently occupying the front pages of newspapers throughout the country, during the program of this evening from 9 to 9:30 o'clock.
     Walter Harrison, a well-to-do, middle-aged man, is charged by the state with killing by poison his ailing wife, Emily Harrison.  The defense claimed that Harrison loved his wife deeply, that she was suffering from an incurable sickness and that he gave her the death-dealing dose because she begged him to end her pain.
     The Trial of Walter Harrison raises again a question that has never ceased to be a topic of popular interest and argument--namely--has any human being the right to take the life of a loved one suffering from a seemingly incurable sickness?
     Was Harrison justified?  Listeners will hear the details of the case, the testimony, and the jury's verdict in this exciting courtroom reenactment.  The broadcast will originate in the New York studios of Mutual's Newark affiliate, WOR.

From the November 16th 1938 edition of the Abilene Reporter-News: 

     On a recent "Famous Jury Trials" broadcast over the Mutual Broadcasting system, listeners were asked to write letters stating their preferences concerning the types of trials they wished reenacted in these courtroom broadcasts.  Although no inducement was offered, many hundreds of letters were received, expressing preferences as follows:
     Murder trials, 94 percent.
     Racket cases, 3 percent.
     Miscellaneous  (breaking of wills, comedy, kidnapping), 3 percent.

 THE trial of Gertrude Barton, one of the most famous crimes in history will be presented tonight at 8 over WIBA on the "Famous Jury Trials" program.
     It was Malcolm Barton's young son by a former marriage, Jerry, who accused his step mother of poisoning her husband in order to inherit his insurance.  But the boy frankly admitted that he had always hated his stepmother.  Gertrude Barton, the stepmother, was an unintelligent immigrant woman who protested her love for her husband and insisted that if she had administered arsenic to him, it was a tragic mistake--that she had intended to give medicine to defeat the "evil eye", just as she constantly gave him "love powders" to "help him retain his love."
     The trial of the testimony in court led to other murders and finally to the most cold-blooded series of crimes in American court history.

 FOLLOWING its policy of presenting outstanding trials based on all types of court problems, "Famous Jury Trials" presents tonight, the memorable courtroom battle of James and Amy Brent for the custody of their 5-year-old daughter.
     Brent's plea for divorce from his career-loving wife was readily granted, but the problem of what to do about the custody of the child was one to puzzle a modern Solomon.  The judge's wise decision brought a surprise finish to this noted trial.
     This "Famous Jury Trial," "James Brent Versus Amy Brent," will be heard tonight over WIBA at 8.

      Beginning next Friday, Oct. 10, "Famous Jury Trials," moves from Monday to Friday night over the NBC-Blue network and WIBA.
     With the naturally dramatic background of our courts of justice, and sometimes the shadow of the electric chair in the background, this court trial show has become for many listeners one of the most thrilling programs on the air. 
     Its stock of material is the history of our courts of justice, with all the dramatic action that attends criminal trials of all sorts.  By following the actual court routine of testimony, cross examination, attorneys' sum-ups, and verdict, it is able to transmit the actual suspense of the courtroom to radio listeners.
     Presence of a judge, bailiff, attorneys, and an audience of "courtroom spectators" heightens the reality of the program to such an extent that the actors actually lose themselves in their roles.  Nationally known actors are used, changed weekly, except for the Judge, who is always played by Maurice Franklin.

     Interest in the spectacular developments during the trial was thus heightened by the unusual circumstances where an accused killer's own father pleaded for the life of his son before the jury.

      Famous Jury Trials, the dramatizations of celebrated court cases of recent years heard Friday evenings at 9 p.m. over WIBA, are vivid proof of the old adage that truth is stranger than fiction--exemplified in countless legal dramas.
     The famous Jury Trials recreated for the waves all are based on actual occurrences and are the brain children of Martin H. Young, an active New York trial lawyer since 1923.
     The series was born of Young's desires to demonstrate the workings of America's law courts in graphic, personal style and came into being at the time of the trial of Bruno Richard Hauptmann for the murder of the Lindbergh baby.
     Young explains that the Hauptmann trial convicted him that "unless some counter publicity were to be given to emphasizing the traditional fairness and freedom of the judiciary from the clamor and prejudice of the mobs, the system must soon lose the respect so necessary for its preservation."
     Young says he drew inspiration for this radio series from Chief Justice Harlan F. Stone of the U.S. Supreme Court and the latter's continual efforts to elevate the dignity of the courts.  Young's personal hobby is music.  He was graduated from Columbia University's Law School in 1923.  He is married and the father of a small son.
     There is only one axiom which guides Famous Jury Trials.  The guilty person or persons are always ferreted out by the end of the trial and pay the penalty.

"THE Trial of James Rix," one of the strangest cases of court history, will be re-enacted tonight at 8:30 over Station WIBA during the presentation of "Famous Jury Trials."
     Rix was accused of attempting to hold up a street-car conductor and shooting him down in cold blood when the latter resisted.  Though three of the car's passengers and the victim himself, before he died, all positively identified him as the killer, Rix went to trial stoutly maintaining his innocence.
     A desperate fight was waged by his attorney, and the unique case was followed by a development which proved again that fact is often stranger than fiction.

From the May 22nd 1942 edition of the Capital Times: 

 THE historic trial of Nurse Edith Cavell will be recreated tonight at 8:30 over Station WIBA during the presentation of Famous Jury Trials when Claudia Morgan, talented radio and stage actress, plays the title role made famous in the movies by Anna Neagle.
     Edith Cavell became one of the outstanding heroines of the first world war, and has been praised throughout the world as a martyr to the cause of mercy.

     Famous Jury Trials will recount the series of events that led up to her trial in Belgium, including her part in the thrilling escapes made by British soldiers trapped behind the German lines at Mons.  She was accused of treason against the Imperial-German Crown and tried as a spy.

In an effort to break up the attachment, he severely whipped his daughter, but this merely precipitated a crisis, for the frightened and resentful girl promptly ran off with Gordon and married him. However, in her note of "goodbye", she neglected to say they had been married. Enraged, the father pursued them, found them at a hotel, and after a brief argument, killed his new son-in-law. The defense claimed that the slaying occurred without the father's knowing the two had been married, and also as the result of a threatening move on the part of the slain man. The exciting trial and the final jury verdict will be heard over WIBA at 9 p.m.

The murdered men were former employers of Finch's firm. The bitterly-fought court trial was complicated by conflicting testimony. A prosecution witness testified that Finch had been at the scene of the crime. A defense witness swore that Finch had never left her home during that evening. The devise used by an attorney to prove which witness was lying, made the trial one of the most unusual ever held. It will be presented as tonight's "Famous Jury Trial" over WIBA at 8:30.
